Can I refuse my car being written off in the UK?
I have a 2024 Toyota Yaris 1.2 petrol engine, and I want to know if I can refuse the car being written off, even though it's over 3 years old. My insurance company says that I can't, but they haven't told me why.
The car has been used for commuting, a couple of times only though, in total less than 100 miles. I think that I would be allowed to refuse it being written off in the US, but I don't know if this is the case here.
If I refuse the car being written off will I have any sort of penalty for doing so? In this case, your car insurance company does not pay out a claim if you do not accept the loss. If you do not accept the loss, you are technically considered to have no proof of loss and the claim would be denied.
In the US, we have what is called a "financial responsibility law". Basically, if you hit a pedestrian, you're supposed to have insurance that will cover the pedestrian's medical bills, and the liability of the driver (to a certain amount, depending on the state). This is a hard law to enforce, since it's easy to get around, but it is a law that most drivers have to obey.
In the UK, there is no similar law. There is no requirement for insurance, so any driver can legally drive without insurance. That being said, it is likely that your insurance company will be willing to pay out a claim, if you are involved in an accident that is your fault, but they might not if you refuse to accept the loss. Basically, if you hit a pedestrian, you're supposed to have insurance that will cover the pedestrian's medical bills, and the liability of the driver (to a certain amount, depending on the state).
Can I drive my car away from Copart?
Yes. Copart allows customers to move the items that they have bought in their cart from one vehicle to another, if they need to. The customer can also buy extra bags from a Copart store or if they are on holiday they can get them delivered to their home. In general terms, moving an item is not an expensive process. Items worth 40 or less will usually not incur any additional charges, while for those items that are more expensive, a surcharge will be applied, but you will always receive an email reminder before and after the move. If you are moving a very large item, we may charge more for an extra hand to help us move it, and we require a minimum of four hands (one person moving it per hand). For larger items that require a crane, a third party company will be employed to move the item from your car. This could cost you 80 or more, so if you feel it is beyond the scope of what you're willing to pay, then we recommend you leave it at the warehouse. What if I've made a mistake with my delivery details? Once you submit your order we will send you a confirmation email which includes your delivery address, and as well as your mobile number, in case there's a problem with the delivery. If you believe you did not receive a copy of this email, please check your spam box or contact us on [email protected], which will provide you with a phone number and/or an email address to use when contacting us.
I got an invoice for my order, why? During the checkout process, you will be sent a confirmation email confirming that you have placed an order. We always send our invoices by email and this email will state how many items you've ordered and a unique reference number. There will also be a section for you to pay any additional charges you may have incurred, as well as any shipping costs you've paid. It's important to make sure that you have the same email address which you registered for when registering on Copart.
As soon as we receive your payment, we will confirm the order and send you an email with the status of the order.
Can I cancel my Copart membership and get refund?

No. The copart membership is non refundable. To make a claim for reimbursement, you must fill in the form available on the Copart website under the tab "My claim".
There is a 2.5% transaction fee applied when returning a used item.
Can I send it back to India? It's possible, however the Copart India team will take your items away for examination upon receipt. Copart customers can find details about this process on the Copart return policy website.
If you've been sent a product that is incorrect or broken due to an error on our part, the item will be exchanged and the purchase price reimbursed. The item must be returned in original condition within a 30 days of your purchase. You'll get a refund, or a replacement if you didn't receive what you purchased within 7 days of your purchase. We can offer an extra 15 days to complete a return at no additional cost if a product is sent by the client directly to us from his own country. You will have the time to return the goods. Note: The time limit is only valid if the packaging and origin are in accordance with the standard and customs/duties charges.
If you use a courier service (such as SpeedPost) or if the order is delivered without proof of shipment, the extra 15 days are not allowed. You have 30 days to claim a refund or an exchange. If you don't claim within 30 days, we can't take any action for the refund. What if I need a refund, but haven't claimed it? Please send us a message with a description of your problems. It is easier for us to process and manage your case. The Refund Department can check all of your cases and give you some feedback about your options.
If you want to request a refund and have not claimed it after 60 days, you will not get your money back. You will get a voucher instead.
It's worth mentioning that we can't force a customer to sign up for a longer period, as there is no rule to this effect. How long can I keep the unused product? The 'residual value' may change in the future.
